Automatex – Terms of Use

These Terms of Use („Terms”) govern your use of the Automatex application („Automatex”, „the App”), provided by StarGateDev („we”, „us”, „our”). By installing or using Automatex, you agree to be bound by these Terms. If you do not agree, do not install or use the App.

1. Eligibility

Automatex is intended only for users who are at least 18 years old and who have the legal capacity to enter into a binding agreement. By using the App, you represent that you meet these requirements.

2. License and Use of the App

Subject to your compliance with these Terms, we grant you a limited, non‑exclusive, non‑transferable, revocable license to use Automatex on devices that you own or control for your own business or personal social media management purposes.

You agree that you will not:

• Reverse engineer, decompile or attempt to derive the source code of the App, except where permitted by law.
• Modify, distribute, lease, rent, sell or sublicense the App or any part of it.
• Use the App in any manner that violates applicable laws or regulations.
• Use the App to create, promote or distribute spam, malware or harmful content.

3. Accounts and Security

You may need to create an account to use certain features of Automatex. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately if you suspect unauthorized use of your account.

4. Content and Responsibilities

You are solely responsible for all content that you create, upload, schedule or publish using Automatex, including any text, media, links and metadata („User Content”). You must ensure that your User Content:

• Complies with all applicable laws and regulations.
• Respects the rights of others, including privacy, intellectual property and personality rights.
• Complies with the terms, policies and community standards of any third‑party platforms where you post.

You must not use Automatex to create, store, publish or distribute any illegal or harmful content, including but not limited to:

• Child sexual abuse material (CSAM) or any content that sexualizes or exploits children.
• Content that incites violence, hatred or harassment.
• Malware, phishing or fraudulent content.
• Unauthorized advertising (spam) or misleading marketing.

By using the App, you grant us a limited, non‑exclusive, worldwide license to process your User Content solely for the purpose of providing and improving Automatex and related services.

5. AI‑Powered Features

Automatex may include AI‑assisted features that generate or suggest content. You understand and agree that:

• AI outputs are generated automatically and may not always be accurate, complete or appropriate.
• You remain fully responsible for reviewing AI‑generated content before using or publishing it.
• You will not use prompts or outputs to attempt to generate illegal, harmful or abusive content, including CSAM, exploitation of children or incitement to violence.

We may restrict or block access to AI features in order to protect users and comply with our safety standards and legal obligations.

6. Third‑Party Services

Automatex may enable you to connect to third‑party services (for example, social media platforms or analytics providers). Your use of these services is governed by their own terms and privacy policies, not these Terms. We are not responsible for third‑party services or how they process your data.

7. Purchases and Subscriptions

Paid features or subscriptions may be offered through Google Play or other authorized stores. Pricing, billing and renewal terms are determined by the store and applicable local laws. Refunds are handled in accordance with store policies unless otherwise required by law.

8. Prohibited Uses

You agree not to use Automatex to:

• Violate any applicable laws or regulations.
• Violate the rights of children or create, store or distribute CSAM or grooming content.
• Interfere with or disrupt the normal operation of the App or its infrastructure.
• Attempt to gain unauthorized access to any systems, accounts or data.
• Engage in automated scraping, bulk data harvesting or similar activities, except as expressly allowed.

9. Intellectual Property

Automatex, including its logo, design, code and documentation, is owned by StarGateDev and protected by copyright and other intellectual property laws. These Terms do not grant you any ownership rights in the App or its content.

10. Termination

We may suspend or terminate your access to Automatex at any time, with or without notice, if we believe that you have violated these Terms, engaged in unlawful activity or created risks for other users or the public.

You may stop using Automatex at any time. Upon termination, the license granted to you under these Terms will end, but provisions that by their nature should survive will continue to apply (including liability limitations and dispute provisions).

11. Disclaimers

Automatex is provided on an „as is” and „as available” basis, without warranties of any kind, whether express or implied. To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose and non‑infringement.

We do not warrant that the App will be uninterrupted, error‑free or secure, or that it will meet your specific requirements. You use Automatex at your own risk.

12. Limitation of Liability

To the maximum extent permitted by applicable law, StarGateDev will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or data, arising out of or in connection with your use of Automatex.

Where liability cannot be excluded, it will be limited to the amount you have paid (if any) for the use of Automatex during the twelve (12) months preceding the event giving rise to the claim.

13. Indemnification

You agree to indemnify and hold harmless StarGateDev, its affiliates, and their officers, employees and partners from any claims, damages, losses or expenses (including legal fees) arising out of or related to your use of Automatex, your User Content or your violation of these Terms or applicable law.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the updated version on this page and update the „Last updated” date above. If you continue using Automatex after the changes take effect, you agree to the revised Terms.

15. Governing Law

Unless otherwise required by mandatory law, these Terms are governed by the laws of your country of residence without regard to its conflict‑of‑laws principles. You and we agree to submit to the non‑exclusive jurisdiction of the competent courts in that country.
